4. Accounts and registration

5. Student access and parent responsibility
Where services are used by or for a student under 18:
- the parent or guardian is responsible for account registration and payment unless otherwise agreed
- the parent or guardian confirms they are authorised to provide the student’s information
- the parent or guardian is responsible for supervising the student’s use of the services where appropriate
6. Fees, subscriptions and billing
Some services are offered on a one-off payment basis and others on a recurring subscription basis.
All prices are shown in Australian dollars unless otherwise stated.
By purchasing a subscription, you authorise us and/or our third-party payment processor to charge the applicable fees on a recurring basis until cancelled.
Unless otherwise stated at checkout:
- subscriptions are billed in advance
- subscriptions renew automatically
- access continues for the paid billing period unless cancelled earlier by us for breach of these Terms
We may change prices from time to time. If we do, we will apply the new price to future billing cycles only after giving reasonable notice.
7. Cancellations
You may cancel a subscription at any time through your account settings, payment portal, or by contacting us.
Unless we state otherwise:
- cancellation prevents future renewals
- cancellation does not usually entitle you to a refund for the current billing period
- access continues until the end of the current paid period
8. Refunds and consumer rights
We handle refunds in accordance with our Refund Policy and the Australian Consumer Law.
9. Acceptable use
You must not:
- copy, sell, license, share or redistribute our content except as permitted by law or by us in writing
- share login access outside the permitted user group for your plan
- attempt to reverse engineer, scrape, hack, disrupt or interfere with the website or platform
- manipulate scores, rankings, submissions or test results dishonestly
- impersonate another person
- upload or submit unlawful, offensive, infringing or harmful content
We may suspend or terminate access if we reasonably believe misuse has occurred.

All intellectual property rights in our platform and materials, including tests, questions, explanations, reports, branding, text, graphics, layouts and downloadable resources, are owned by or licensed to Elite Scholars unless otherwise stated.
You are granted a limited, revocable, non-exclusive, non-transferable licence to use our materials for personal, non-commercial educational use only.

We may provide performance-related information such as:
- scores
- section breakdowns
- written feedback
- progress trends
- percentile-style comparisons or rankings, where offered
These are provided for educational and informational purposes only and do not constitute official school assessment or guaranteed selection outcomes.
12. Live mock exams and scheduled sessions
Where we provide live or timed mock exams:
- students must follow the exam instructions and timing rules
- we may reschedule, postpone or cancel a session if reasonably necessary
- we are not responsible for interruptions caused by your device, internet connection, software, local environment or third-party outages
Where feasible, we will try to provide an alternative session, credit or other reasonable solution if a session cannot proceed as planned.
13. Writing feedback and educational material
Any feedback, comments, reports or suggestions we provide are educational in nature only. They are not official school assessments, psychological assessments, or legal, medical or professional advice.
14. Third-party services
We may use third-party services, including payment processors, website hosts, analytics providers, email and SMS providers, video platforms and LMS tools.
15. Website availability
We try to keep the website and platform available, secure and functional, but we do not guarantee uninterrupted, error-free or continuous access.
We may modify, suspend, remove or update any part of the platform at any time.
16. Liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, including loss of profits, loss of opportunity, loss of data or disappointment arising from the use of our services.
To the extent permitted by law, where liability cannot be excluded, our liability is limited to resupplying the relevant services or paying the cost of having those services supplied again, where such a limitation is lawful and applicable.
17. Termination

- payment is unsuccessful and remains outstanding
- your conduct puts the platform, business or other users at risk
Termination does not affect rights or obligations that arose before termination.
